The Supreme Court today directed real estate group Unitech to deposit Rs 2 crore more to refund 39 home buyers of its housing project, Vista, in Gurgaon after it failed to handover the possession on time.
The court also denied to rely on Unitech’s assurance of possession by 2017 and granted four weeks time to deposit the aforesaid amount.
The company had already deposited 15 crore with the investors following court’s earlier order.
While passing the order, the apex court bench of Justice Dipak Misra, Justice Amitava Roy and Justice AM Khanwilkar said that “Rome was not built in one day and the foundation of any economy was the faith that a buyer reposed in the seller”.
The court said that interest and compensation for failure to deliver the possession of flats will be considered at the next hearing of the case in the second week of January next year.
The court, in its order, noted the agony of the buyers as they told the bench that even after paying the entire amount they were still without a roof of their own and were living in rented accommodations.
More than 20 buyers had approached the National Consumer Disputes Redressal Commission after the builder failed to handover the possession.
Yesterday, the Noida authority had also accused the firm of selling flats without getting necessary approvals from it.
