New Delhi, Jul 8: The Delhi High Court today ordered constitution of a three-member medical board to examine film producer and 2G scam accused Karim Morani, who has sought interim bail on health grounds, and submit a report within three days.

“The medical superintendent of GB Pant Hospital is directed to constitute a board of three doctors to examine Karim Morani and submit a report on his medical condition and the suggested line of treatment within three days,” said Justice Ajit Bharihoke, who had earlier come down heavily on the CBI for filing an incomplete medical report of Morani without any opinion of the treating doctor. 

The court warned that in case the hospital fails to file the report of 53-year-old Morani, who is lodged in Tihar Jail, within the stipulated time, its medical superintendent will have to appear in person before it.

The court slated the matter for next hearing on July 14.

The court's direction came on an application by the CBI that the doctors at the hospital have declined to comment on “the line of treatment and nature of ailment” of Morani without examining him.

The counsel for the CBI submitted that Morani had not visited the hospital since June 30 and doctors do not want to opine on his medical condition without examining him. 

The court, which was hearing Morani's plea for interim bail on health grounds, directed the Tihar Jail Superintendent to take him to the hospital for medical examination.  It also asked the superintendent and the medical officer of Tihar Jail to ensure proper treatment to Morani. 

A special CBI court had ordered arrest of Morani, , who has been accused of facilitating routing of Rs 200 crore bribe from a firm promoted by Shahid Usman Balwa to DMK-run Kalaignar TV, after dismissing his bail plea on May 30. 

During the last hearing on July 6, the court had asked the CBI to file a fresh report on Morani's health condition within three days after the CBI, in its preliminary report, had refuted Morani's claim.

The CBI had claimed that Morani's physical examination revealed regular pulse rate, normal blood pressure with no postural fall and no other significant abnormality of cardiovascular system.

The agency, however, had not attributed the report to the doctor, who examined Morani and this led the court to rebuke it.

Earlier, the court had directed the Tihar Jail Superintendent to provide proper medical facilities to Morani as per doctors' advice.

The CBI had accused Morani of taking Rs six crore for facilitating the transaction of illegal gratification to Kalaignar TV.

Besides Morani, 13 persons including DMK MP Kanimozhi have been arrested in the case.

Three companies, Swan Telecom, Unitech Wireless (Tamil Nadu) Ltd and Reliance Telecom Ltd, have also been named as accused in the case. PTI
