New Delhi, Apr 13: Dentist  Nupur Talwar, after evading arrest  from CBI sleuths for the last two days, today appeared before the Supreme Court, which granted her a breather  till her appeal against the non-bailable warrant was disposed of by the apex court.

The Central Bureau of Investigation assured the Supreme Court on Friday that it would not arrest her while her appeal against the non-bailable warrant was pending before the apex court.

A bench of Justices A K Patnaik and Swatanter Kumar referred Nupur's plea against the non-bailable warrant to the Chief Justice of India.

Till then, the bench said it had ''full faith in the CBI'' that Nupur would not be arrested.

Nupur Talwar faces arrest in the twin murders of her teenaged daughter Aarushi and domestic help Hemraj nearly four years ago.

Nupur, who has allegedly evaded arrest, was present in the Supreme Court during Friday's proceedings.

She had moved the Supreme Court yesterday seeking a stay on the non-bailable warrant (NBW) issued against her by a CBI trial court.

A bench of justices A K Patnaik and Swatanter Kumar had posted the matter for today.

A special CBI court had issued a non-bailable warrant against Nupur Talwar two days ago for failing to appear in court despite the one-month reprieve given to her by the Allahabad High Court. While a CBI team landed at the Talwar home in Hauz Khas to look for her on Thursday evening, they were told she was not at home.

Nupur and husband Rajesh Talwar are the prime accused in the 2008 murder of their daughter Arushi and help Hemraj.

In the court of Special Magistrate Preeti Singh, Nupur's counsel had argued that since a review petition against her arrest was coming up before the Supreme Court on April 27, she should be allowed to stay away from the CBI court proceedings till then.

The CBI, however, accused her of “willfully evading her appearance” and sought a non-bailable warrant. The court accepted this, and said the warrant was being issued as Nupur had “not adhered to the high court order” in staying away from court today. The next date of hearing for April 18.

The CBI said it would file an application with both the Allahabad High Court and Supreme Court that in case she files an appeal with either, it should be in the presence of the agency's representatives.

While Rajesh Talwar was present in court, there was no movement in his case. The CBI appeal that the bail granted to him by the Supreme Court be revoked comes up on May 7.

CBI officials said the impression given out by Nupur that the agency was hounding her was absolutely baseless. They maintained that no attempt was made to arrest her after 11 am on Thursday after she moved the Supreme Court seeking relief against the NBW issued by the Ghaziabad court.

The officials said that they were tracking Nupur's movement in pursuance of an earlier Supreme Court order asking her not to leave the borders of National Capital Region.

The CBI said it had to inform in case she violated the Supreme Court order.

The CBI court in Ghaziabad had earlier this week issued the NBW against Nupur after she failed to appear before it in connection with the twin murder case of Aarushi and domestic help Hemraj.

The agency had carried out searches at her premises in Delhi and neighbouring Noida on April 11 following the warrant issued against her, but had not been able to locate her.

Nupur and her husband Rajesh Talwar, also a dentist, are facing trial in the nearly four-year-old twin murder case.

Aarushi was found dead with her throat slit at their Noida residence on the night intervening May 15 and 16, 2008, while the body of Hemraj was recovered from the terrace of the house the next day.
