New Delhi: Former military dictator, Pervez Musharraf would challenge special court's order of not allowing a high profile treason case in the military court.

Musharraf is facing treason trial imposing an emergency, detaining judges, and subverting and abrogating the Constitution in 2007.

Musharraf's lawyers had filed three applications that challenged the appointment of the head of the prosecution team, the establishment and the jurisdiction of the special court.

The special court had denied the treason trial of Musharraf in a military court and had adjourned the hearing till March 11.

Meanwhile, the defence team had argued that Musharraf should be tried by a military court.

The three-judge court, headed by Justice Faisal Arab of the Sindh High Court, had deferred the framing of charges until the apex court announced its verdict on whether or not the special court has the jurisdiction to try the retired general for treason.

Musharraf has been in a military hospital since January 2 after he fell ill while travelling to court.

If convicted for the charges, he would face death penalty.
